Terms of sale
Last updated: October 14, 2026
This English version is provided for convenience. The French version is the legally binding one and prevails in case of discrepancy: read it in French.
Article 1: Purpose
These general terms and conditions of sale (the "Terms of Sale", in French "CGV") govern the sale of Flopilot subscriptions between Flopix, the trading name of the sole proprietorship (entreprise individuelle) operated by Vincent PIERNOT, whose place of business is at 3 rue Amiral Guépratte, 57070 Metz, France, registered with the Metz Trade and Companies Register (RCS de Metz) under number 928 185 420 (hereinafter "Flopix"), and any natural or legal person who takes out a subscription (the "Customer"). Any subscription implies acceptance of these Terms of Sale and of the Terms of Use.
Article 2: Description of the plans
Flopilot is offered as a monthly or yearly subscription, taken out for an organisation (the space that brings together the projects and the people who work on them). Three plans exist as of the date of these Terms of Sale:
| Plan | Accounts | Projects | Storage | Max file | Guests |
|---|---|---|---|---|---|
| Solo | 2 | 10 | 5 GB | 25 MB | 3 |
| Team | 10 | 50 | 50 GB | 50 MB | 25 |
| Business | 30 | Unlimited | 200 GB | 100 MB | Unlimited |
The details of each plan (AI features, number of AI actions per month, connectable applications, length of the activity history) are set out on the Pricing page, which forms part of these Terms of Sale. "Accounts" are the people in the organisation who work in it (owner, administrators, members); guests are not paid accounts.
Article 3: Subscription
Subscribing requires a Flopilot account and a valid payment method with our payment provider Stripe. The subscription is taken out by the owner of the organisation, who is the Customer. It constitutes firm acceptance of the price in force. Flopix may refuse or cancel a subscription in the event of fraud, a previous unpaid amount or failure to comply with these Terms of Sale.
Article 4: Prices and payment
Prices are those displayed on the Pricing page at the time of subscription, namely, as of the date of these Terms of Sale:
- Solo plan: 9,99 € per month on the monthly plan, or 99,99 € per year on the yearly plan;
- Team plan (Équipe, its name in the app): 29,99 € per month on the monthly plan, or 299,99 € per year on the yearly plan;
- Business plan: 79,99 € per month on the monthly plan, or 799,99 € per year on the yearly plan;
Prices are in euros, all taxes included. Payment is made online by bank card via Stripe; Flopix does not store any card data. The subscription is payable in advance and renews automatically on the anniversary date of the subscription, every month on the monthly plan or every year on the yearly plan, unless cancelled. An invoice is issued for each billing period and remains available from the Customer's account area.
If prices change, the Customer is notified by email at least thirty (30) days in advance; the new price only applies from the next billing date, and the Customer may cancel before then.
If a payment fails, Stripe attempts it again over a few days, during which access is maintained. If the situation is not remedied, the subscription ends and the organisation switches to read-only mode (Article 9).
Article 5: Free trial
Flopilot does not offer a free plan. The first subscription taken out by an account starts with a free trial of 7 days, once per account (an account that has already had a trial or a subscription, for any organisation, is not entitled to a new one). During the trial, the Customer has access to all the features of the chosen plan and nothing is charged. A payment method is requested when subscribing.
At the end of the trial, the subscription starts automatically and the first payment is charged, unless the Customer has cancelled before the end of the trial from their account area (Settings > Subscription > Manage); in that case nothing is charged and the organisation switches to read-only mode (Article 9). The Customer is reminded by email a few days before the end of the trial.
Flopix may also grant, on a case-by-case basis, free access to a plan (partner, test, goodwill gesture), for life or until a stated date. Such access involves no payment and no commitment; at its end, the organisation returns to normal operation (read-only until a subscription), without any data being deleted.
Article 6: Right of withdrawal
A consumer Customer is in principle entitled to a period of fourteen (14) days to withdraw from a contract concluded at a distance (Article L221-18 of the French Consumer Code, Code de la consommation). However, Flopilot gives immediate access to the Service as soon as the subscription is taken out (including during the free trial). In accordance with Article L221-28 of the French Consumer Code, a consumer Customer who wishes to have this immediate access expressly requests that performance begin before the end of the withdrawal period and acknowledges that they waive their right of withdrawal. This request and this waiver are collected through a checkbox before payment, and confirmed in the subscription confirmation email.
A Customer acting for the purposes of their professional activity does not benefit from the right of withdrawal, except in the cases provided for by Article L221-3 of the French Consumer Code.
Article 7: Term and cancellation
The subscription has no minimum term. The Customer can cancel it at any time from their account area (subscription management, Stripe payment portal), or by email to [email protected] sent from the address of their account. Cancellation takes effect at the end of the current period (the month or the year, depending on the billing option chosen): the organisation remains fully usable until then. No pro rata refund is due for the period already paid.
Any substantiated complaint (prolonged unavailability, unresolved malfunction) sent to [email protected] is examined on a case-by-case basis; a goodwill gesture may be offered.
Flopix may suspend or terminate the subscription in the event of non-payment, fraud or serious breach of these Terms of Sale or of the Terms of Use, after a formal notice that has remained without effect for eight (8) days, except in an emergency (manifestly illegal content, threat to the security of the Service).
Article 8: Changing plans
The Customer can change plans at any time from their account area (Stripe payment portal). The change takes effect immediately and Stripe calculates the price difference pro rata for the current period: a surcharge is billed when moving to a higher plan, and a credit is applied to the next billing periods when moving to a lower plan.
If the organisation's usage exceeds the limits of the new plan (number of accounts, projects, storage…), nothing is deleted: only new creations beyond the limits are blocked, until usage falls back within the limits or the Customer chooses a suitable plan.
Article 9: End of the subscription and data
When the subscription stops (cancellation or non-payment), the organisation switches to read-only mode: its projects, tasks, notes and documents can still be viewed and downloaded, but nothing can be created or modified any more. Nothing is deleted: the Customer gets everything back by subscribing again.
The Customer may at any time request the permanent deletion of their organisation and its data by writing to [email protected] (or from their account area when this feature is available). Deletion takes place within thirty (30) days, except for billing data, which is kept for ten (10) years under Article L123-22 of the French Commercial Code (Code de commerce).
Article 10: Guests
The Customer may share one or more projects with guests (clients, contractors, partners). Guests are free: they do not take out a subscription and pay nothing. Their number is limited depending on the plan. They only access the projects shared with them and accept the Terms of Use when creating their account.
Article 11: Artificial intelligence and third-party services
The AI features are optional and work with the Customer's own API key with Anthropic. AI usage is billed directly by Anthropic to the key holder, under Anthropic's terms and prices; this cost is not included in the Flopilot subscription. The number of AI actions per month and the features available depend on the plan. AI responses are suggestions that the Customer checks before using them.
Connections to the applications of the Flopix family depend on the availability of those services, which evolve independently of Flopilot.
Article 12: Customer's obligations
The Customer is responsible for the content uploaded to their organisation, for the use made of it by the people they invite and for compliance with the regulations applicable to that content (in particular when it contains third parties' personal data). The Customer keeps their login credentials confidential and turns on two-factor authentication when it is recommended.
Article 13: Availability and liability
Flopix uses reasonable means to ensure the availability and security of the Service (best-efforts obligation, in French "obligation de moyens"), without guaranteeing continuous availability: interruptions may occur for maintenance, updates or external causes. The Customer is advised to keep a copy of their essential documents.
For a professional Customer, Flopix's liability, for all causes combined, is limited to the amounts actually paid by the Customer during the twelve (12) months preceding the event giving rise to liability, and excludes indirect damage (loss of revenue, customers or reputation). These limits do not apply to a consumer Customer beyond what the law allows.
Article 14: Personal data
See the privacy policy. Billing data is kept for ten (10) years (Article L123-22 of the French Commercial Code).
Article 15: Changes to the Terms of Sale
Flopix may amend these Terms of Sale. Significant changes are announced by email at least thirty (30) days before they come into force; a Customer who does not accept them may cancel before that date. The applicable Terms of Sale are those in force on the date of each billing period.
Article 16: Disputes and mediation
These Terms of Sale are governed by French law. In the event of a dispute, the Customer first contacts [email protected]; Flopix replies within thirty (30) days. Failing agreement, a consumer Customer may refer the matter, free of charge, to the consumer mediator: Société Médiation Professionnelle (SMP), Alteritae, 5 rue Salvaing, 12000 Rodez, France, mediateur-consommation-smp.fr. Failing that, the French courts have jurisdiction; a consumer may bring the matter before the court of their place of residence.
